Welcome to khushbu.pk ("Khushbu.pk," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, online store, and related services (the "Services"). By visiting khushbu.pk, browsing our products, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

These Terms should be read together with our [Privacy Policy] and [Refund & Return Policy], which are incorporated here by reference.

1. Eligibility

Our Services are intended for individuals 18 years of age or older, the age of majority in Pakistan under the Majority Act, 1875. By using the Services or placing an order, you confirm that you are at least 18 years old, or that you are placing an order with the involvement of a parent or guardian who agrees to these Terms on your behalf.

2. Products, Pricing & Availability

  • All products listed on khushbu.pk, including our Signature Collection, Discovery Kits, and Twin Pack bundles, are described to the best of our ability, including scent notes, concentration, and size. Actual scent perception can vary by individual skin chemistry.
  • Prices are listed in Pakistani Rupees (PKR) and are subject to change without prior notice. The price charged will be the price displayed at the time your order is placed.
  • We make reasonable efforts to ensure product and pricing information is accurate. In the event of a pricing or listing error, we reserve the right to cancel the affected order and issue a full refund.
  • Product availability is not guaranteed until an order is confirmed. Flash Clearance and limited-availability items are sold on a first-come, first-served basis.

3. Orders & Order Acceptance

  • Placing an order on khushbu.pk is an offer to purchase, which we may accept or decline at our discretion (for example, in cases of suspected fraud, pricing errors, or stock unavailability).
  • For Cash on Delivery (COD) orders, we or our courier partner may contact you by phone or message to confirm the order before dispatch, as a fraud-prevention measure, as described in our Privacy Policy.
  • You are responsible for providing accurate delivery information (name, phone number, and address). We are not responsible for delayed or failed delivery caused by incorrect information provided at checkout.

4. Payment Methods

We currently accept:

  • Cash on Delivery (COD) — available nationwide across Pakistan; payment is collected upon delivery.

5. Shipping & Delivery

  • We aim to fulfil and dispatch orders promptly, though delivery timeframes may vary based on your location and courier availability.
  • Free delivery applies to orders above the threshold stated on our website at checkout (currently Rs. 3,000). This threshold may change from time to time.
  • Risk of loss and title for products pass to you upon delivery to the courier's confirmed delivery address.

6. Returns, Refunds & Exchanges

Our full return, refund, and exchange process — including your statutory rights under the Sale of Goods Act, 1930 and the Punjab Consumer Protection Act, 2005, and our voluntary 15-day Satisfaction Guarantee — is set out in our separate Refund & Return Policy, which forms part of these Terms.

7. Account Registration

If you create an account with us, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at info@khushbu.pk if you suspect unauthorized use of your account.

8. Acceptable Use

When using our Services, you agree not to:

  • Provide false, misleading, or fraudulent information when placing an order;
  • Use the Services for any unlawful purpose, or in violation of the Prevention of Electronic Crimes Act, 2016 (as amended by the Prevention of Electronic Crimes (Amendment) Act, 2025) or any other applicable Pakistani law;
  • Attempt to gain unauthorized access to our website, systems, or any other user's account;
  • Interfere with or disrupt the operation of the Services, including through the introduction of viruses, malicious code, or automated scraping tools;
  • Copy, reproduce, or resell our product images, descriptions, or content without our written permission.

We reserve the right to refuse service, cancel orders, or suspend account access for any user who violates these Terms.

9. Intellectual Property

All content on khushbu.pk — including our logo, brand name, product photography, descriptions, and website design — is the property of Khushbu.pk or its licensors and is protected under applicable Pakistani intellectual property law. You may not use, reproduce, or distribute this content without our prior written consent.

10. Customer Reviews & Submitted Content

If you submit a product review, testimonial, photo, or other content to us (including via WhatsApp, email, or social media), you grant Khushbu.pk a non-exclusive, royalty-free right to use, reproduce, and display that content in connection with promoting our Services. Please do not submit content that is false, defamatory, or infringes on the rights of others.

11. Third-Party Links

Our Services may link to third-party websites or social media platforms (e.g., Facebook, Instagram, TikTok) that we do not control. We are not responsible for the content, policies, or practices of any third-party site.

12. Disclaimers

Our Services and products are provided on an "as is" and "as available" basis. While we take care in describing our products, we do not guarantee that scent performance, longevity, or individual reaction will match every customer's expectations, as fragrance experience varies by individual. Nothing in this section limits your statutory rights described in our Refund & Return Policy.

13. Limitation of Liability

To the fullest extent permitted under Pakistani law, Khushbu.pk shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services or our products, except where such liability cannot be excluded by law (including your rights under the Sale of Goods Act, 1930 and the Punjab Consumer Protection Act, 2005 in cases of defective, damaged, or misdescribed products).

14. Indemnification

You agree to indemnify and hold Khushbu.pk harmless from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the Services.

15. Filing a Complaint

If you have a concern about our Services, you may:

  • Contact us directly — we aim to resolve concerns informally wherever possible.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or in applicable Pakistani law. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Lahore, Punjab.
